FIGHTING FOR JUSTICE


There is no doubt and apparently Hon’ble CAT Ernakulam Bench allowed OA No. 381/2010 on merit leaving no scope for further review or comments. It is unfortunate that Secretary (Finance) without going through the pros and cons of the apex orders has rejected the GP for IPs. Sh. Permanand has rightly said that judgment has been delivered within the parameters prescribed by the Apex Court in respect of the powers of the Tribunal in dealing with the fixation of Pay scale. This all has happened practically but theoretically nothing in text with us. Probably rejection may have taken place but reasonable period is over so we should file contempt and be prepared to go for an appeal.
Hitherto, despite GOI assurance Grade Pay of Income Tax inspectors was not  raised to Rs.4600. The Income Tax union took a serious note of it and decided to intensify the agitational programme in the following manner in the face of the stubborn attitude of their Board:
  • Ensure that no statistical returns / reports are either prepared or sent to the Board and no co-operation in this regard is extended to the Department in any manner officially or un-officially.
  • Non Co-operation in Survey operations u/s. 133A including TDS Survey / inspection / verification / study.
  • Demonstration on the first visit of any Board Member and/or Chairman, in the IT Offices across the country.
  • Non Co-operation in Search & Seizure action u/s. 132 and Survey u/s. 133A conducted by the Investigation wing.

Resultantly after agitation, persuasion they got GP of Rs. 4600/- followed by many other similar placed cadre-men but except Inspector Post.
Punjab Circle is of the view that we should also show our resentment to the Govt in similar fashion besides filing CAT cases in Chandigarh, Lucknow, Patna, Hyderabad, Bangalore and writ petition in Hon’ble High Court at Ernakulam Bench. This issue will be discussed in length in CWC by the representative of Punjab Circle.
